they are a precursor to what will win in february. news keeps coming tonight here is brian with the news news edge starts with a story that may be disturbing to parents. a small child was kicked in a day care. now a 19-year-old employee is facing charges, that is not the only problem police found during their investigation. karen grey houston. >> this is one of those incident that is is a parent's nightmare you leave your child hoping he is well cared for only to find out a care taker may have physically assaulted him. in this case the parents found out when shown a video, the abuse was caught on tape. >> reporter: 19-year-old jonathan cummings was arrested and charged with physical child abuse and second degree assault by officers who went to this house. the incident occurred the previous friday. >> all we have is it was recorded and that he kicked the

2-year-old and admitted to kicking the 2-year-old. >> reporter: no one answered the door when we stopped by the unlicensed day care center operated out of this home. the parents of the boy who was kicked did not want to talk on camera but say as many as 30 or 40 children were cared for there. neighbors were shocked to learn the news. >> that is unbelievable and then unlicensed on top of that. oh, my god. is the home large enough to accommodate that many children number one and number two can you provide the right amount of care for that number at one time >> i hope the child is okay. me being a parent, i am just picking my daughter up from day care, it is a concern you know. >> reporter: the state office of child care has issued a cease and desist order ordering the unlicensed center to stop operations. cummings has been released on $35,000 bond. >> how do you have someone 19 without the proper training,

fever, chills and severe cough. flu outbreak has spread to almost every state. in maryland emergency room visits are skyrocketing. the strain of flu is hitting earlier and causing severe symptoms. audrey. >> reporter: health officials say this could be the worst flu season in a decade. already in maryland more than 2300 people have been diagnosed with the flu and the season is only really just getting started. visits to the pediatric emergency room at shady grove hospital are up 25% and adult visits have spiked between 10 and 20%. people are coming in with very high fivers and the 102-degree range, muscle aches and headaches patients say it feels like the worst cold they have ever had and then some. not everyone who gets the flu needs to head to the emergency room. >> if you get sick, the best thing to do if you are otherwise healthy take tylenol,

widespread outbreaks many of them a new mutation. >> the strain is more viralent than some others. >> reporter: that is happening so much in illinois, monday, 11 hospitals had times waiting from 4 to 12 hours stopped taking nonemergency patients because of the influx of flu patients in boston the flu outbreak prompted officials to declare a public health emergency. >> significant rates of hospitalization, more serious than the last two years. >> reporter: near philadelphia, one hospital has a triage tent outside to treat patients with flu symptoms. tamiflu is in high demand and short supply in parts of texas. your best defense, roll up your sleeve. >> vaccine is a good vaccine it

planet venus. it will be one of the brightest things in the sky here for the next number of weeks followed closely by the sun. we will get the sunshine back in here tomorrow. high temperatures today, 58 degrees st. louis and dallas that is not bad atlanta, 65 degrees. wilmington north carolina, 75 degrees. dc 50, boston 45 degrees. nice temperatures close to 50 degrees again tomorrow but we might be able to add 10 to 15 degrees on to that 50-degree reading by the time we get to the weekend. we are looking at a warm up, tonight is not bad so many nights we have been looking at temperatures down in the low 20s at 11:00 p.m., frederick a cold spot, 43 degrees not a cold spot, dc 47, culpepper 36, we will likely drop into the 30s most areas tonight but it will not be bitterly cold. around the region, new york

depart. coming from this system, energy breaking off from a big soaker of a storm across texas and louisiana. mostly about the heavy rain. we keep that moisture at bay for the time being as high pressure builds in tomorrow blocking it out keeping it on the cool side but as the high shifts east, on friday, it will give a little bit of a room for that low pressure to move up to the great lakes and sprea maybe a few showers in here although i have to tell you it is not looking like a lot of rain. we could use more than we are probably going to get. your fox 5, accu weather seven- day forecast. a couple days near 50 degrees, friday showers in the afternoon, certainly more cloud. saturday and sunday, 62 degrees on saturday, 65 on sunday, we will bring a few more showers back into the picture monday, tuesday and wednesday, keeping that trend of above normal temperatures going. not bad at all. before you know it we will be

talking about baseball. i won't go there yet. baseball will be here soon enough. the 2012 red skins season is now in the books. next up, robert griffin the third getting ready for 2013. he had a 5 hour surgery this morning in florida to repair the l cl and what proved to be a complete tear of his acl. the typical recovery time is 6 to 8 months. according to a report mike shanahan reviewed the game tape and believes it took place on the play right before the low snap that took griffin to the ground. he rolls out and gets checked by bruce urban. the focus is on rg iiiest rehab which started today. a statest from dr. andrews.

he had successful knee surgery a direct repair to his lcl and redo of his previous acl reconstruction. we expect a full recovery and it is everyone's believe he will be ready for the 2013 season. tim high tower who tore his acl, october 2011 has this advice for griffin. >> one thing important for him is not putting a timeline on it, let his body dictate that and going out there, and just a, finding a group of people he trusts and who know what they are doing, who are going to make sure that he has the things in front of him he needs. he is a hard worker. you can't argue that. he is passionate he will push him he has to do the things he has to do to be ready when he is supposed to be ready. coming up, turns against

a story of survival. a florida baby is home after she was shot while still in her mothers womb. after a month -- about a month ago her mother was walking out of a convenience store, when she was shot in the head and abdomen. her arm was broken but otherwise healthy her mother is still in the hospital. looks like sunshine back tomorrow, a cooler air mass moving in. 51 degrees. fasten your seat belts for the weekend low and mid-60s. >> thanks. see you back here tomorrow
